I offer mediation, mediation-to-arbitration, arbitration, and other specially negotiated dispute resolution services.
 

Mediation is a type of alternative dispute resolution in which a neutral, impartial person (the mediator)   facilitates communication to resolve disputed issues.  It is alternative to litigation in court.  Participation is voluntary.  You only reach resolution if YOU agree.  It is confidential and private.  You can participate with or without legal counsel.  How long it takes depends on the type of issues, how ready each  person is to address the issues, and how many issues there are.  Creative compromise and nuanced solutions are explored. The mediation takes place in the mediator’s conference room unless otherwise agreed.   Agreements are written down. 

 

 

A settlement conference is a type of mediation in which the parties are already involved in litigation and the legal issues have been prepared for hearing or trial.  Usually parties are represented by legal counsel.  A caucus format is most common.  More forensic evaluation and directive assistance from the mediator is expected.  Resolution results in a CR2A agreement or agreed orders.

 

 

Private Arbitration is another type of alternative dispute resolution in which the parties agree that a neutral, impartial   person (the arbitrator) will decide the case.  The general process of presenting        information or evidence is less formal than a trial.  The process remains confidential and private.  You can participate with or without legal counsel.  How long it takes depends on the type of issues, how ready each person is to address the issues, and how many issues there are.  The  arbitration takes place in the arbitrator’s conference room unless otherwise agreed.  The decision is written after the arbitration hearing.  A mediation can be converted to an arbitration if the parties agree.
